Terms
The terms.
What you are agreeing to, in full, and before you are asked for anything.
Effective 27 October 2026
Elevate Wellbeing is a trading name of Elevate Health & Fitness LLC. All agreements are entered into with the LLC.
By enrolling in a coaching program or booking a session with Elevate Health & Fitness LLC, you acknowledge and agree to the terms below. Where a signed agreement conflicts with these terms, the signed agreement controls.
1. Scope of services. Elevate provides movement programming, habit frameworks, general nutrition guidance for healthy adults, strength and recovery protocols, and live wellbeing sessions. Services are educational and supportive in nature. They are not medical advice, diagnosis, treatment, physical therapy, clinical nutrition therapy or psychological counseling, and they do not replace care from a licensed professional. All physical activity carries inherent risk of injury. Participants assume that risk voluntarily and should consult a physician before beginning any new routine.
2. A cycle means four weeks. Throughout these terms a cycle is one four week period. It is the billing period and it is the period a session belongs to. Because a cycle is four weeks rather than a calendar month, a full year contains thirteen cycles and therefore thirteen payments rather than twelve.
3. Online coaching, $299 every four weeks. One price, and everything Elevate does for an individual client is inside it: a wellness vision session at the outset; live coaching calls of twenty five minutes, being four in the first cycle, one in each week of it; two in each of the second and third cycles; and one in each cycle thereafter; a recorded video review in most weeks, in which Ian Kendall reviews the footage and the data the client has submitted and explains the programming for the week ahead; individualized programming, rewritten when the client’s circumstances change rather than at a fixed interval; and messages answered inside a working day by Ian Kendall personally. It also includes access to the Elevate coaching platform from the day the client joins, which carries the client’s program, habit tracking, a connection to Apple Health, Garmin, Fitbit or Oura where the client uses one, and the messaging and footage described above in a single place. There is no separate charge for the platform, no separate charge for programming and no separate charge for the health coaching element. The number of live calls reduces across the first four cycles by design rather than by omission, because the purpose of the service is that the client needs it less over time. Where a client wishes to return to a higher frequency of live contact in any cycle, Elevate will do so on request, at no additional charge, up to the frequency provided in the first cycle.
4. The first three cycles. Online coaching is taken for a minimum of three cycles, which is twelve weeks. The reason is stated plainly on the site: the aim of the work is that the client can make these decisions without Elevate, and that is not reached in four weeks. After the third cycle the arrangement continues four weeks at a time with no fixed term, nothing renews automatically beyond the next cycle, and the client ends it by saying so in writing. No notice period is required and no exit interview is a condition of leaving.
5. Three days to change your mind, and a full refund. A client may cancel a new subscription by telling Elevate in writing within three days of the first payment, and the whole of that payment is refunded. This applies even though payment is taken before the first session, even though the platform has already opened, and even though the client is inside the first three cycles. No reason has to be given, no deduction is made for access already had, and nothing further is owed. This right is granted by Elevate rather than claimed under any statute, and it is the protection that sits against section 6.
6. How an engagement begins, and when payment is taken. Every engagement begins with a free coaching conversation of approximately twenty five minutes. It is a coaching conversation rather than a sales call: it is about what a good life looks like for that person, and it is useful whether or not anything follows. It costs nothing, no payment method is taken to book it, and a client who does not proceed owes nothing and is not contacted again unless they ask to be. Where Elevate offers to proceed and the client accepts, the first payment, at the price published when they join, is taken at that point, before the first coaching session. It is taken then because delivery begins then: the platform opens the same day with the client’s program in it, and the first coaching session is scheduled into the days that follow. Elevate does not operate a free trial that converts into a paid subscription, and does not take a payment method before the client has said yes. The three day right in section 5 applies from that first payment.
7. Your rate is the rate you joined at. Where a published price changes, existing clients continue at the price they joined at for as long as their subscription remains active. That protection applies to every price Elevate has ever charged. Clients who joined at earlier prices, $199 among them, continue at those prices on the same basis. The published price of online coaching is $299 every four weeks. Until 31 December 2026, or until the places described here are taken if that happens first, Elevate is releasing places at lower prices: the next five clients to join do so at $199 every four weeks, and the five after those at $249. A client who takes one of those places keeps that price under the protection above, for as long as their subscription remains active. The lower price is the thing being offered rather than a temporary rate that later rises, so no client on a released place will see their rate increase. After those ten places, and in any event from 1 January 2027, the published price of $299 applies. Every client on a released place has the same three cycle minimum, the same three days to change their mind and the same right to end the arrangement as any other client. A place is taken when a first payment is taken, and not when a call is booked or an intention is stated, so the price that applies to any client is the price published at the moment their first payment is made. Elevate will not release more than five places at $199 or more than five places at $249, and will withdraw each price from the site once its places are gone, which may be before 31 December 2026. Where Elevate publishes a figure comparing one of these prices against another, such as a saving across twelve weeks or across a year, that figure is arithmetic from the published prices and assumes the subscription remains active for the period stated. It describes a price difference and is not a guarantee of any result. On 15 October 2026 Elevate replaced an earlier rate card of $650 every four weeks on a three cycle commitment, $575 on six and $499 on the year. On 22 October 2026 Elevate replaced health coaching at $349 and the separate health coaching addition at $99 with the single price of $299 described above, and reduced remote training sessions from $75 to $60. Later the same day Elevate replaced the fifty minute remote training session at $60 with an additional coaching call of thirty minutes at $39, described at section 11. A client who had already paid for a fifty minute session at $60 or $75 receives that session in the form bought. A client who was paying $75 a session pays $39 for the shorter call from that date, because a reduction is passed on and an increase is not. No client’s rate was increased on either occasion, and no client’s rate has ever been increased by Elevate.
8. Sessions belong to a cycle. The coaching calls provided in a cycle, and any additional calls bought under section 11, are scheduled inside that cycle. They are not a balance that accumulates, and a session not taken in a cycle does not carry into the next one. What the fee reserves is a recurring place in a schedule that is deliberately limited in size, and that place is held whether or not every minute of it is used.
9. Rescheduling, and when Elevate cancels. A session may be moved to another time inside the same cycle where Elevate has availability and the client gives at least twenty four hours notice. A session canceled or missed with less than twenty four hours notice is treated as delivered. Where Elevate cancels a session, or is unable to deliver one, that session is rescheduled inside the same cycle where possible; where it is not possible the following cycle is reduced by the corresponding amount, at Elevate’s cost rather than the client’s.
10. The twelve week review, and Elevate’s undertaking to recommend stopping. At the end of the third cycle Elevate repeats the baseline measures taken at the outset and reviews them with the client. Where Elevate believes the client no longer needs paid support, Elevate undertakes to say so and to recommend stopping, and to put that recommendation in writing. This undertaking is given deliberately and against Elevate’s own commercial interest. Where a client wishes to continue with support but no longer requires programming, a reduced arrangement is available after the third cycle at $129 a cycle. It comprises one coaching call of twenty five minutes every other week and a written check in each week, answered within one working day. It does not include programming, a recorded review or application access. It is taken four weeks at a time, it is available only to a client who has completed three cycles of online coaching, and it is ended by one message.
11. An additional coaching call, $39, added to a cycle. A client already taking online coaching may add further live coaching calls of thirty minutes to any cycle, at $39 a call. They are not sold on their own and they are not a package: the client decides how many to add to a given cycle and they are placed in the calendar at that point. What is being bought is time held inside that four week period, which is why those calls are scheduled within it and do not transfer to a later cycle. No discount attaches to buying more of them, and a client may add none in one cycle and several in the next. The rescheduling provision at section 9 applies to them.
12. Individually quoted arrangements. Where Elevate and a client agree an arrangement that is quoted individually rather than published, the written quote governs that arrangement and these terms apply to anything the quote does not address.
13. Live sessions in buildings and workplaces. A forty five minute wellbeing session covering sleep, breathing and recovery, delivered in person at a property or workplace, or remotely for distributed teams, for up to thirty participants. The first session at any property or workplace is free and carries no obligation. After that, a building may book a single session at $450 or a standing slot at $350 every four weeks, and an employer may book a single session at $550 or a quarter at $2,400, being four sessions across twelve weeks invoiced once. Where a session or a quarter is delivered live by video rather than in person, the same session and the same report are provided and the price is $425 for a single session and $1,900 for a quarter, the difference reflecting the absence of travel. A standing slot ends whenever the client says so, with no notice period and no renewal that happens on its own.
14. What Elevate provides, and what the client provides. Elevate provides the session, printed participant materials, setup and cleanup, and a written report after each session. The client provides a suitable room with seating, or a video link for remote sessions, and one communication announcing the session to the people invited.
15. Participation and cancellation. Attendance is voluntary and no minimum turnout is guaranteed. Participants remain seated and no strenuous activity is involved. Either party may cancel or reschedule with seventy two hours notice at no charge. A session canceled by the client with less than seventy two hours notice is invoiced in full. A session canceled by Elevate is rescheduled at no charge.
16. What the report contains, and what it never contains. The report states how many people attended, what the room asked about in aggregate, and the one change offered that week. It contains no names, no health information, no attendance roster and nothing capable of identifying a participant. No figure is reported where fewer than five people responded, which means that in a small room some questions are returned unanswered rather than answered in a form that could identify somebody. Where a participant later becomes an individual coaching client of Elevate, the property or employer is not told, and nothing arising from that work is returned to them. These limits are set out in full in the Privacy Policy and they are limits on Elevate rather than settings a client can change.
17. Groundwork. Groundwork is a small group program of seven forty five minute group calls across eight weeks, with a cap of twelve places and a minimum of four. The seventh week carries no call by design. The first group begins 12 January 2027 and ends 2 March 2027, at $275, and every group after it is $375. The first group is priced below the ladder because it is the first and has no record behind it. A participant keeps the price of the group they joined. The fee is paid in full at booking, or in two equal payments four weeks apart. Where a participant begins online coaching within thirty days of the final evening, $100 of the fee is credited against their first cycle, at whatever price is published when they begin. The first group ends after the released places at section 7 have closed, so a participant who completes it and continues pays $199 for their first cycle and $299 for every cycle after it. The credit is $100 and not the whole fee, because Groundwork is a complete eight week program rather than a deposit against another one. Where fewer than four people take a place the group does not run, and everybody who has paid is refunded in full without having to ask. Where Elevate cancels or moves a group for any other reason the same applies. Calls are not recorded, which is deliberate and protects the openness of the group; a participant who misses a call receives a written recap, and missed calls are not refunded or rescheduled. Until Groundwork is open for sale, giving Elevate a name creates no contract, reserves no place and takes no payment.
18. Insurance and vendor compliance. Elevate Health & Fitness LLC carries commercial general liability coverage through Hiscox Insurance Company Inc. at $1,000,000 per occurrence and $2,000,000 general aggregate, together with separate cyber and data risk coverage of $250,000. Certificates of insurance are provided on request and are issued in the name of the LLC.
19. Intellectual property. All exercise media, audio, program structures, session materials and recorded instructional material remain the exclusive property of Elevate Health & Fitness LLC. Material shared with a client is licensed for that client’s personal use and may not be redistributed, resold or used to deliver services to others.
20. Refunds. Because payment is taken at the start of a cycle rather than at the end, Elevate holds money for work not yet done, and these are the rules for it. Within three days of the first payment, section 5 applies and the whole payment is refunded. After that, a cycle already begun is not refunded, because the platform, the program and the coaching time have been made available for it. A cycle paid for but not yet begun is refunded in full on request. Where Elevate ends an engagement, or cannot deliver, every amount paid for a cycle not yet delivered is refunded without the client having to ask. Sessions canceled with less than the notice stated in these terms are treated as delivered.
21. Governing law. These terms are governed by the laws of the State of Oregon. The parties will first attempt to resolve any dispute through good faith negotiation for thirty days. Any unresolved dispute is settled by binding arbitration in Multnomah County, Oregon.
22. Changes to these terms. Material changes are reflected in a revised effective date above. Active clients are notified in writing of any change that reduces the protections described here, and no change applies retroactively to a cycle already paid for.
