Privacy Policy

Elevate Health & Fitness LLC ("we," "our," or "us") is dedicated to protecting personal privacy and operational metrics. This policy outlines our data processing standards.

1. Data Collection & Purpose: We collect personal identifiers and self reported lifestyle biometrics solely to deliver coaching services, manage amenity portals, and communicate regarding programming. Private coaching data will never be sold, rented, or distributed to advertising networks.

2. Software Infrastructure & Third Party Processing: Digital coaching portals operate via trusted software infrastructure (including Everfit, Stripe, and Loom). Data transmitted through these platforms is governed by their respective security terms. Elevate Health & Fitness LLC maintains commercially reasonable administrative and technical safeguards to protect client communications.

3. Property & Executive Reporting: For B2B property contracts, we provide property management teams with summary attendance overviews. Individual resident profile data, private workout notes, and coaching conversations remain confidential and excluded from building reports.

4. Statutory Compliance & Data Access: As an Oregon based entity operating in the United States, we adhere to applicable state consumer privacy laws, including the Oregon Consumer Privacy Act (OCPA) and California Online Privacy Protection Act (CalOPPA) standards regarding notice, transparency, and data access requests. User records can be permanently deleted upon formal written request to ian@elevatewellbeing.coach.

Master Terms & Conditions

Effective Date: August 15, 2026

By enrolling in a private coaching program or executing a commercial property agreement with Elevate Health & Fitness LLC, you acknowledge and agree to the terms detailed below.

1. Scope of Services & Professional Boundaries: Elevate Health & Fitness LLC provides remote movement protocols, habit frameworks, strength programming, and automated digital amenity setups. Services are educational and physical conditioning in nature and do not constitute licensed medical advice, diagnosis, physical therapy, clinical nutrition, or psychological counseling.

2. Private Practice Program Structures:

12 Week Foundation ($1,950): 12 week onboarding partnership ($1,950 pay in full or 3 installments of $685 every 4 weeks). Graduate retainers ($299/mo quiet support; $699/mo executive strategy) renew automatically every month until canceled in writing prior to billing.
Private Strategy Blocks: Available as 4 session ($249), 8 session ($449), and 12 session ($599) packages.

3. B2B Corporate & Residential Agreements:

Commercial Billing & Volume Tiers: Property amenity management operates on 12 month agreements ($999/mo Single Property Core + $1,200 setup; $799/mo Multi Property Hub + $999 setup per bldg; $699/mo Regional Enterprise + $799 setup per bldg). Setup fees and monthly retainers are non refundable.
Founding Properties Program: Limited to the first 10 signed properties. The setup fee is waived. The initial term runs 3 months rather than the standard 12 month agreement. Monthly platform fees still apply and are billed at the standard rate for the property's tier. At the end of the 3 month term, the agreement converts to standard 12 month terms for the applicable tier unless either party elects not to continue, with written notice provided at least 14 days before conversion. Participating properties grant Elevate Health & Fitness LLC the right to reference program results, in aggregate or property specific form, for marketing, case study, and promotional purposes.
Unlimited Resident Capacity: All commercial tiers include uncapped, unlimited resident user access.
Custom On Site Filming (75 Core Videos): Elective on site production shoots ($4,999 one time fee).
Planned Operator Leave: Reserves right to execute up to 4 calendar weeks of planned operational leave per year while digital programming remains active.
Regional Deployment: Capped at two primary property contracts per zip code.

4. Personal Shield, Liability Waiver & Hold Harmless: All physical activity carries inherent risk. Clients voluntarily assume all physical risks. All contractual obligations are strictly those of Elevate Health & Fitness LLC. Clients explicitly waive the right to seek personal asset recovery against Ian Kendall individually.

5. Intellectual Property & Media Hardware: All exercise media, audio, QR hardware designs, and app structures remain exclusive intellectual property. Upon contract termination, physical QR hardware must be removed from property walls.

6. Refund Policy: Due to digital asset provisioning, software mapping labor, custom hardware manufacturing, and scheduling allocations, all payments carry a strict zero refund policy.

7. Governing Law, Venue & Binding Arbitration: Governed strictly by the laws of the State of Oregon. Any legal proceeding shall be settled exclusively by binding arbitration administered by the American Arbitration Association (AAA) in Portland, Oregon (Multnomah County).
